he European Insurance and Occupational Pensions Authority published a draft regulatory technical standard (RTS) for uncleared swaps under the European Market Infrastructure Regulation (EMIR), updated rules covering the clearing obligation under EMIR, and recommended an extension of clearing exemption rules to intragroup transactions. They said that a review of the EMIR framework for intragroup exemptions for contracts with third countries, and its interaction with the Capital Requirements Regulation, would be desirable. As the current temporary exemptions regime expires on June 30 2022, the draft RTS propose extending the temporary regime by three years.

CFTC warns on swap reporting errors

The US Commodity Futures Trading Commission (CFTC) warned reporting firms about misreporting swap data. The CFTC’s data division issued guidance warning Swap Execution Facilities, Designated Contract Markets and other reporting counterparties of their obligations to correct data errors within at least seven days, and to self report breaches. In particular, it has warned about issues regarding terminated trades. CFTC aims to highlight a specific swap data reporting error—swaps that erroneously appear in swap data repositories as open swaps, despite having been terminated—and notify market participants of the scope of this error; remind market participants of ongoing obligations to correct swap data errors.
